Terms of Use

These terms are the agreement between you and Nueva Luxe LLC, which operates Quiet Index. By using the app, you agree to them. They are written to be read, not to be impressive.

The service

Quiet Index is an app for keeping track of books, movies, and shows that people recommend to you, and for sending recommendations to others. It is operated by Nueva Luxe LLC (“we”, “us”).

Your account

You need an account to use the app. You agree to give accurate information when you create one, to keep access to your email secure, and to be responsible for what happens under your account. You must be at least 13 years old to use Quiet Index.

What you put in the app

You keep ownership of the recommendations and notes you write. By sending a recommendation to someone, you allow us to store it and deliver it to the person you chose. You are responsible for what you write, and you agree not to use the app to send anything unlawful, abusive, harassing, or infringing on someone else’s rights.

We may remove content or suspend accounts that break these terms or that harm other people using the app.

Early access

Quiet Index is new. While it is in TestFlight or early release, features may change, and we may reset accounts or data as the app develops. We will give notice in the app or on this site before doing anything that would erase your library.

Paid features

Some features may be offered as a paid subscription in the future. If they are, prices and what is included will be shown in the app before you are charged. Purchases are processed by Apple, and are subject to Apple’s terms. Refunds are handled by Apple, not by us. Subscriptions renew automatically unless you cancel through your Apple account settings.

Ending the agreement

You can stop using Quiet Index at any time and ask us to delete your account by emailing hello@quietindex.app. We may suspend or end your access if you break these terms, or if we stop offering the service.

The app is provided as it is

We work to keep Quiet Index running well, but we provide it “as is” and without warranties. We do not promise that it will always be available, error-free, or that your data will never be lost. Keep your own record of anything you cannot afford to lose.

Limits on liability

To the extent the law allows, Nueva Luxe LLC is not liable for indirect or consequential losses arising from your use of the app. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim, or $50, whichever is greater. Nothing in these terms limits rights you have that cannot legally be limited.

Changes

We may update these terms. If we do, we will change the date at the top of this page, and tell you in the app if the change is significant. Continuing to use the app after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules.
